CIVIL LITIGATION AND PROBATE DISPUTES

Contentious  probate proceedings are a nuanced, specialised claim that must be handled with the utmost care. Failing to plead a claim will cause the suit to be struck-out; the Firm understands this and is dedicated towards dealing with all aspects of a contentious probate proceeding.

Companies are tricky creatures and it is of the imperative that any dispute pertaining to shareholding is carefully handled.

CORPORATE ADVISORY

 

Corporate advisory work is a specialty of the Firm. ARBITRATION

 

Some disputes between corporations (but increasingly, between individuals) contain a mandatory arbitration clause. This will necessitate that the matter be disposed of in the Asian International  Arbitration Centre. ​

Gavin Jayapal has extensive experience in handling arbitration matters, with the principal of the firm having been involved in, amongst others, an arbitral dispute involving a claim for RM 2billion. 

CORPORATE AND PERSONAL INSOLVENCY

 

Bankruptcy and winding-up are growing problems in today's world of ever-tightening deadlines.

ADJUDICATION

 

The Construction Industry Payment and Adjudication Act (CIPAA) 2012 represents a significant milestone in the Malaysian construction industry. CIPAA seeks to reinvent the wheel when it comes to the speedy resolution of disputes pertaining to payment.

COMMITTAL PROCEEDINGS

Committal proceedings are the zenith of the civil litigation process.

When one has been accused of breaching a Court order, committal proceedings are initiated to punish a wrongdoer for acting in contempt of Court.

The Firm has moved several applications for committal. We have also acted as Counsel in resisting applications for committal with great success.

THE FIRM

GAVIN JAYAPAL was formed from the vision of its principal, Gavin Jay Anand Jayapal. 

A graduate of the University of Leeds and a Barrister-at-Law of the Middle Temple, Gavin has an unwavering passion for all aspects of litigation, advocacy and dispute resolution. 

Gavin also holds a Masters in Law from the University of Malaya and is an Accredited  Mediator with the Malaysian Bar. He is also a Member of the Asian Institute of Alternative Dispute Resolution (MAIADR).

He is actively involved in numerous matters at all levels of the Malaysian Judiciary, having represented clients in the High Court, Court of Appeal and Federal Court. The success of the Firm is measured against how effectively our Clients' rights are protected and how effectively a legal solution is procured. 

Having extensive Courtroom experience has served Gavin Jayapal well; the Firm is uniquely positioned to advise clients as to the best manner in which to structure corporate agreements and contracts. In this way, our Clients' rights are always kept protected.  

The Firm prides itself on being ethical, passionate and result-orientated. Integrity lies at the foundation of the Firm and it is upon this rock that it is built. 

The Firm is also a zealous supporter of continuing professional development. Gavin regularly delivers talks for and on behalf of the Malaysian Bar pertaining to the fundamentals of company law. He has also worked with CLJ Law and has delivered talks for them pertaining to insolvency, company law and the handling of witnesses. 

 

Gavin is also accredited as a contributing author to the inaugural edition of Thomson Reuters's Malaysian Civil Procedure 2013 (known colloquially as "the White Book". He is also listed as a contributing author to the 2018 and 2021 editions of the White Book.
